Membership Agreement

1. Parties 
   a) Gürsoy Tarımsal Ürünler Gıda San. ve Tic. A.Ş. (the "Company), with its registered address conducting the operations of the website www.gursoyshop.com.  
   b) The internet user who becomes a member of the website www.gursoyshop.com (the Member).

2. Subject of the Agreement
   The subject of this Agreement is to define the conditions under which the Member can benefit from the services provided by the Company on the website www.gursoyshop.com.

3. Rights and Obligations of the Parties
   3.1. The Member declares and undertakes that all personal and other information provided during membership registration on www.gursoyshop.com is true and accurate before the law. The Member agrees to indemnify the Company for any damages it may incur due to the inaccuracy of this information.  
   3.2. The Member shall not share the password provided by www.gursoyshop.com with any third party or organization, and the right to use said password belongs solely to the Member. The Company reserves the right to claim damages against the Member for any unauthorized use leading to claims from third parties or authorities.  
   3.3. The Member agrees and undertakes to comply with applicable laws while using the website www.gursoyshop.com. Any legal or penal liabilities arising from violations of the law shall solely and exclusively bind the Member.  
   3.4. The Member shall not use the website www.gursoyshop.com in a manner that disrupts public order, is contrary to general morality, harasses or disturbs others, or serves illegal purposes, nor shall they engage in activities that prevent or hinder others from using the services (e.g., spam, viruses, Trojans, etc.).  
   3.5. Opinions and thoughts expressed, written, or used by Members on the website www.gursoyshop.com are entirely their personal views and bind only the opinion holder. The Company bears no responsibility for any damages incurred by third parties due to the views expressed by the Member or for any damages incurred by the Member due to views expressed by third parties.  
   3.6. The Company shall not be liable for unauthorized access to the Member's data or for any damages that may occur to the Member's software and data. The Member has accepted in advance that they shall not claim compensation from the Company for any damages that may arise from the use of the website www.gursoyshop.com.  
   3.7. The Member agrees not to access or use the software and data of other internet users without authorization. Any legal and penal responsibilities arising from such actions shall rest solely with the Member.  
   3.8. A Member who violates any one or more of the provisions contained in this membership agreement shall be personally liable for any criminal and legal consequences of such violations, and the Company shall be held harmless from the legal and penal consequences of such violations. Furthermore, in the event of legal proceedings arising from such violations, the Company reserves the right to seek damages from the Member for failure to comply with the membership agreement.  
   3.9. The Company reserves the right to unilaterally delete the Member's membership and any files, documents, and information belonging to the customer when deemed necessary. The Member accepts this provision in advance, and the Company shall have no liability in this case.  
   3.10. The software and design of the website www.gursoyshop.com are the property of the Company, and copyright and/or other intellectual property rights related to these are protected by applicable laws. They may not be used, acquired, or modified without authorization by the Member. Other companies and products mentioned on this website are trademarks of their respective owners and are also protected under intellectual property rights.  
   3.11. For the improvement and development of the website www.gursoyshop.com, the Company may collect certain information such as the name of the internet service provider used to access the site, the Internet Protocol (IP) address, the date and time of access, the pages accessed during the session, and the website address that allows direct access to the site.  
   3.12. The Company may use the personal information of the Member for better service delivery, improving its products and services, and facilitating the use of the site, tailored to the personal preferences and interests of the Members. The Company reserves the right to keep records of the Member's actions on the website www.gursoyshop.com.  
   3.13. The person who becomes a member of www.gursoyshop.com consents to being presented with product and service promotions, advertisements, campaigns, advantages, surveys, and other customer satisfaction initiatives by the Company and all its subsidiaries, under the existing and/or future applicable practices. The Member also consents to the collection of their personal and shopping information and consumer behavior data for the above purposes, as well as sharing, using, and archiving such information by the Company and its subsidiaries. Unless the Member notifies otherwise, they agree to the continued collection of data, sharing with the Company and its subsidiaries, usage, and archiving even after their membership ends. The Member consents to being contacted by all subsidiaries of the Company through internet, phone, SMS, and other communication channels unless stated otherwise. The Member agrees not to hold the Company or its subsidiaries responsible for any direct and/or indirect damages incurred due to the collection, sharing, use, archiving, and access to their personal data. Detailed information regarding the Member's personal data can be found in the Privacy Policy document.  
   3.14. The Company may disclose the Member's personal information when legally required or if it believes in good faith that such disclosure is necessary to comply with legal requirements, respond to legal processes served on the Company, or protect and defend the rights and property of the Company and www.gursoyshop.com.  
   3.15. Measures have been taken to ensure that the website www.gursoyshop.com is free from viruses and similar malicious software within available means. Additionally, for ultimate security, the user must provide their own virus protection system and ensure necessary protection. In this context, the Member agrees that they are responsible for all errors that may occur in their software and operating systems as a result of entering the website www.gursoyshop.com and for any direct or indirect consequences thereof.  
   3.16. The Company reserves the right to change the content of the website at any time, modify or discontinue any service provided to users, or delete registered user information and data on www.gursoyshop.com.  
   3.17. The Company may change, update, or cancel the terms of this membership agreement at any time without prior notice or warning. Any modified, updated, or revoked provision shall be effective for all Members from the date of publication.  
   3.18. The parties agree that all computer records of the Company shall be accepted as the sole and authentic evidence in accordance with Article 287 of the Code of Civil Procedure, and that these records constitute a contract of evidence.  
   3.19. The Company is authorized to send informational emails to the electronic mail addresses registered by its Members and informational SMS messages to their mobile phones. The Member agrees to the receipt of such informational emails and SMS messages by confirming this membership agreement. If the Member wishes to opt out of receiving emails and/or SMS messages, they can perform the cancellation process for mail and/or SMS sending through Membership Preferences.  

4. Termination of the Agreement
   This agreement shall remain in effect until the Member cancels their membership or until their membership is canceled by the Company. The Company reserves the right to unilaterally terminate the membership if the Member violates any provision of this membership agreement.

5. Dispute Resolution
   In the event of disputes arising from this agreement, the competent courts of Istanbul shall have jurisdiction.  

6. Enforcement
   The registration of the Member implies that they have read and accepted all provisions contained in this membership agreement. This Agreement is concluded at the moment the Member registers and comes into mutual effect.
